1 Identity of the company

2 Definitions
2.1. Company: FNG
2.2. Customer: the physical person that, exclusively for non-professional purposes, uses or acquires products or services that were brought on the market and enters into a distance contract with the entrepreneur.
2.3. Distance contract: any contract concerning goods or services concluded between a company and a Customer under an organized distance sales or service-provision scheme run by the supplier, who, for the purpose of the contract, makes exclusive use of one or more means of distance communication up to and including the moment at which the contract is concluded.
2.4. Goods: all products offered by FNG on our Website
2.5. Website: the Website of FNG, accessible via www.fri-day.com
2.6. Means of distance communication: any means which, without the simultaneous physical presence of the company and the Customer, may be used for the conclusion of a contract between those parties.

3 Applicability
3.1.Our General terms of use are applicable to every offer of FNG and for every concluded distance contract between FNG and the Customer, unless parties agreed upon on beforehand and in writing. These General Terms and Conditions apply only to the physical person that, exclusively for non-professional purposes, uses or acquires products or services that were brought on the market and enters into a distance contract with the entrepreneur.
3.2.In order for the Customer to place an order, he/she must be at least 18 years old. If you are not 18 years old we kindly ask you to let your parents or legal guardian place your order. In case we notice the order has been placed by a minor, we reserve the right to reject your order.
3.3.In case the distance contract is concluded electronically, the general terms of use will be electronically available to the Customer before the distance contract will be concluded or at the moment of delivery of the Goods at the latest, in a manner that the Customer can easily save it on a durable medium or print it.
3.4.If additional particular terms of use apply apart from these general terms of use, all of the above also applies to those particular terms. In case of differences between the general and particular terms, the clauses from the particular terms will prevail. The non-replaced clauses from the General Terms will remain in force.
3.5.General terms of the Customer are not applicable, unless FNG agrees explicitly on beforehand and in writing.
3.6.FNG reserves all rights to adapt these general terms and conditions if necessary at any moment.
3.7.The Customer acknowledges the acceptance of these general terms and conditions by the fact of placing an order on the Website.
3.8.In case one or more clauses of these general terms and conditions are considered void, invalid or inapplicable based on whichever reason, the other clauses of these general terms and conditions remain in force. These general terms and conditions are considered to be the only applicable agreement between parties regarding to its subject matter


4 Offer
4.1 Offers are valid for the period mentioned on the Website and subject to availability.
4.2 In case the offer depends on certain conditions, these conditions will be explicitly mentioned in the offer.
4.3 FNG always describes what it sells to you as complete and accurate as possible. In any event, FNG makes sure that the description is detailed enough for you to make a proper assessment. In case we use images, these will be a representative display of the offered products and/or services. Obvious mistakes or errors in the offer do not bind the company.
4.4 The order is definitive from the moment the Customer receives a confirmation notice from FNG and FNG receives an acceptance notice from the card issuer.
In case the card issuer refuses to accept payment, FNG cannot be held responsible for any delay in delivery or non-delivery of the Goods ordered by the Customer. Orders made by the Customer without payment by the registered cardholder will not be accepted.


5 The contract
5.1
The Customer can return his online purchase without giving any reason and within 15 days after receipt of the items by the Customer himself or by his representative prior notice free of charge revoked under certain conditions. The Agreement will be terminated .
5.2 Customer can use this right by using the enclosed return label and -form within the period prescribed in Article 5.1 to send the package back. The customer can return free of charge with the label by PostNL Parcel Shop . Once the return has been received by us and processed gets the Customer report this by email .
5.3 If the Customer use a different way of his right, the withdrawal costs are incurred with the return paid by the Customer.
5.4 Customer supplied items in case of restitution may only - as is also is common in the shop fitting - use to decide whether he wishes to retain the article. The items must be returned with original labels and price tag attached .
5.5 If impairment occurs because the items have been used as mentioned in contravention of the provisions above Friday reserves the right to claim damages , which is never higher than paid by the customer for the item. 5.7 Friday is not liable for any damage, theft or loss , which occurs when returning to the package or the product.

6 Prices
6.1 All prices are mentioned in euro and VAT and other governmental taxes included.
6.2 The Customer is bound by the price he/she accepted during the final step of the ordering process and which FNG confirmed in the confirmation e-mail. Obvious mistakes in price setting by FNG can be corrected by FNG at all times, even after conclusion of the contract.
6.3 Shipping fees and fees for returning Goods will be communicated clearly to the Customer. Certain means of payment may be subject to special conditions. These conditions will be communicated on beforehand.
6.4 Prices listed online at the Website do not include shipping . On base of selection of transmission time and / or -method Friday calculates the amount of the shipping cost. The amount of the shipping costs will be communicated during the order process on the website clearly to the Customer.
6.5 Friday can not be held responsible for color variations due to monitor quality.

7 Delivery
7.1 Friday exercised the greatest care when receiving and sending the orders .
7.2 Friday delivers the items within the Netherlands by PostNL , while stocks last.
7.3 Orders will be delivered as soon as possible. When a good is on stock, we will make our best effort to deliver within a period of 3 working days. If a good is not available on stock, we will do our best to deliver your order within a period of 3 to 6 working days. We inform you of the delivery period in your order confirmation. If we are not able to deliver on time, we will always notify you before the to the end of the delivery period. If we do not, you can cancel your order for free. In that case we will refund you within 30 days after dissolution of the agreement.

8 Delivery address and delivery service
8.1 The Customer can choose his shipping address. If he wants to change his choice in retrospect, he can call Customer Service .
8.2 Requests to change the delivery address can only be done if the order has not been sent.

9 Reservation of ownership
9.1 We reserve all ownership on the goods until you will have paid the total amount due (costs included). In the meantime, you are not allowed to sell the goods or to burden them in any way whatsoever.

10 Registration
10.1 To make optimal use of the Website, the Customer can register by the registration / account options on the Website.
10.2 During the registration process customer chooses a username and password with which he can log in after registering on the Website. Customer is responsible for selecting a sufficiently reliable password.
10.3 Customer must keep his username and password strictly confidential . Friday is not liable for abuse of login data and should always assume that a customer who registers on the website is actually the Customer. Everything is done through the account of the Customer, under the responsibility and risk of the Customer.
10.4 If the Customer knows or suspects that his credentials have come into unauthorized hands , he shall as soon as possible change his password and / or notify Friday so that Friday can take appropriate action.

11 Protection of personal data and creditors
11.1 The data needed to be stored for the settlement of the order of the Customer and in connection with the settlement of any order given to firms with Friday or affiliated companies that perform some of the services provided by Friday .
11.2 Friday reserves the right , as already stated in Article 6.3 , to conduct an analysis of the data provided by you and to offer an alternative payment method based on information obtained.
11.3 All personal data will be treated in strict confidence of the Customer and the legal rules of data protection and privacy is strictly observed by Friday . Friday will not sell or transfer the personal data of the Customer.
11.4 In cases where personal data are provided to third parties by Friday, these third parties are not entitled to use such information for any purpose other than to perform their duties. The third Friday which works are bound by the terms of Friday , which ensures the privacy of the Customer.
11.5 If the Customer has signed by an act or explicit consent for deals and general information Friday , the personal data of the Customer can be used for private information purposes as described in 11.4. If the Customer does not appreciate unsolicited information from Friday (by post, phone or e- mail) , the Customer may at any time opt out and object to the further use of your personal data for commercial communications through the phone or email co to share our Customer Service . 12 Complaints and Consumer Protection

12.2 If the customer has a complaint about a delivered product , he shall as soon as possible after the defect has manifested itself , or can take the customer as reasonably aware of , contact with Friday . Friday recommends the Customer whatsoever to inspect the product upon receipt.
12.3 Contrary to the previous paragraph stipulates specific to Customer not acting in the exercise of his profession or business , he have to inform by Friday, as soon as possible but in any case within two months from discovery of the defect or after purchasing the item.
12.4 Friday has a customer service that objective will solve any problems and / or complaints, always in consultation with the client and in the best possible way . The complaints procedure (link to website ) clearly described on the Website.

13 Conformity and guarantee
13.1 We guarantee that our products are in accordance with your order and meet the normal expectations you may have taking into account the specifications of the product. We also guarantee that our goods are in accordance with any at the moment of your order applicable law
13.2 As a Customer, you have right to a statutory 2-year warranty on goods purchased from us if this good is not in accordance with the placed order. During this period and within the legal limits, we provide for the free replacement or repair of goods showing a defect covered by the statutory warranty. To the extent of what is possible or reasonable, you have a choice between replacement or repair. Only if replacement or repair is excessive or impossible, or impossible to offer within a reasonable time, you have the right to a reduction or to demand the dissolution of the contract of sale. During the first six months, you can in all cases call upon the guarantee. Afterwards you have to prove that the defects in the goods were not caused by abnormal use.
13.3 You will be asked to present your purchase receipt or invoice if you want to call on the guarantee. Every defect needs to be declared within 2 months, afterwards every right to replacement or repair is expired.
13.4 We never guarantee for defects caused by accidents, not following the washing prescriptions, incorrect use.

14 Force majeure
14.1 In case of force majeure, we are not obliged to fulfil our obligations. In that case we may either suspend our obligations for the duration of the state of force majeure or definitely repudiate the agreement.
14.2 Events of force majeure are all circumstances external to our will and control that render the respect of our obligations completely or partly impossible. Such events include amongst others strikes, fire, disruption of energy supplies or telecommunication networks or communication systems and/or the temporary down-time of the webshop, late delivery or absence of delivery by suppliers or other third parties.

15 Guarantee
15.1 This article only applies if there is a customer who does not act in the exercise of his profession or business and is subject to Article 12. If there is given a separate guarantee on the products by Friday this applies without prejudice to the newly set for all types of customers .
15.2 Friday guarantees that the products comply with the agreement , the specifications stated in the offer, the reasonable requirements of reliability and / or usability and on the date of the conclusion of the agreement existing legal provisions and / or government regulations . If specifically agreed , Friday also means that the product is suitable for other than normal use.
15.3 Friday has its own 6-month warranty on all products. If the Customer finds a defect on delivery or within this period, he has the right to subject to lodge a complaint ( Art. 12) and if the complaint is valid product to trade for the same specimen or for repair. This concerns the same product in the same size. If exchange is no longer possible , Friday will refund your purchase price . A complaint is unfounded if the defect has arisen through normal wear and tear by wearing the products. (normal wear and tear)
15.4 A guarantee provided by Friday , manufacturer or importer does not affect the legal rights and claims that the Client under the Agreement has and may invoke .
15.5 If the delivered product does not comply with the Agreement, Customer must notifying Friday as soon as possible after he discovered the lack.
15.6 If Friday the complaint deemed valid, the relevant products will be restored, replaced or refunded after consultation with Customer. The maximum compensation is in compliance with Article 13 on liability equal to the price paid by Customer for the product.

16 Applicable Law and Disputes
16.1 All contracts we conclude with our customers are, regardless of their place of residence, exclusively governed by Dutch law.
16.2 Only the courts of The Netherlands are competent to adjudicate with disputes arising out of or connected to these contracts. If as a result of international law the law of a different country applies, the interpretation of the current terms and conditions will in the first instance be done in accordance to the Dutch Law on Market Practices and Customer Protection.
16.3 If any provision of these Terms is found to be invalid, this will not affect the validity of the entire Terms and Conditions. The parties in this case will replacing ( a ) new provision (s ) to establish, which as far as legally possible to the intent of the original provision is shaped .
16.4 "By letter" falls alsoTerms such as e- mail, provided the identity of the sender and the integrity of the mail is sufficiently established .
16.5 With electronic communication received or stored version by Friday, Friday applies of that message as the authentic version , unless the customer can prove that this version is not authentic.
